To the extent permitted by applicable law, all implied warranties are hereby excluded and disclaimed, including but not limited to implied warranties or merchantability, fitness or purpose, quality, course of dealing, trade usage and trade practice. The foregoing warranty shall terminate in any event six (6) months after the Product is delivered to a customer. Upon receipt of adequate documentation from Consignee, DMS shall replace defective Products in a commercially reasonable amount of time.
